Terms of Service

1. Eligibility

You retain ownership of your User Content. However, by submitting User Content, you grant Unfrag a worldwide, non-exclusive, royalty-free license to use, reproduce, display, distribute, and modify such content solely for the purpose of operating and improving the Service.

You represent that:

  • Your User Content does not violate any law or third-party rights.

5. Intellectual Property

The Service, including its software, branding, logos, text, graphics, and other content, is owned by Unfrag or its licensors and is protected by applicable intellectual property laws.

Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from the Service.

6. Purchases and Payments

If the Service offers paid products, subscriptions, or services:

  • Fees are displayed before purchase.
  • Payments are processed through authorized payment providers.
  • You agree to provide accurate billing information.
  • Unless otherwise stated, fees are non-refundable.

We reserve the right to change pricing at any time.

We do not control and are not responsible for third-party content, products, services, or practices. Your use of third-party services is governed by their own terms and policies.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNFRAG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNFRAG AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

  • $100 CAD; OR
  • THE AMOUNT YOU PAID TO US DURING THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Unfrag and its affiliates, officers, employees, and partners from claims, damages, liabilities, and expenses arising from:

  • Your use of the Service;
  • Your User Content; or
  • Your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time if:

  • You violate these Terms;
  • We are required by law; or
  • We determine termination is necessary to protect the Service or other users.

Upon termination, your right to use the Service immediately ends.

13. Privacy

Your use of the Service is also governed by our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time.

Updated Terms become effective when posted on the Service. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Saskatchewan and the laws of Canada applicable therein, without regard to conflict of law principles.
